A three-judge district court on Tuesday rejected North Carolina lawmakers' request for a stay on a ruling that found the state's congressional map was unconstitutional.

Judges James Wynn, William Osteen and W. Earl Britt of the U.S. District Court for the Middle District of North Carolina ruled that the lawmakers had failed to meet the "heavy burden" required to stay the order.

scotus will probably do the same thing they did with Noth Carolina.

NC relied on federal law I think while this is purely state law. Scotus shouldn't even be involved.

Yes, but if you want any chance of success, you need to cite Federal Law and/or the Constitution.

IANAL, but I imagine it depends on what their challenge is.  I think it is certainly at least true  that the constitution and even federal law can supersede state law.  though that doesn't necessarily mean it does.  this challenge could be some garbage hail mary that scotus will dismiss without comment.

The US Constitution does supersede State Law, Federal Law might. Or might not. As you said, it would depend on the nature of the State law, both the law regulating the district construction and the law the court relied upon to overturn the districting as well the State Constitution and the Federal law that is relevant.

Hey lawyers - any idea how common decisions where the majority doesn't write an opinion beyond the order are?

This country will not survive electing Trump

I'm just going to distract myself with some light entertainment, like a show about the Nazis and Japanese winning WW2 and dividing America between them

My dad, who was a history prof for 40 years fwiw, told me this election proved to him that democracy can't work over the long run.

Just, if anyone is thinking of suicide, take one of the gop donors with you.

Hah, I went looking for an answer to this and found a paper on the subject.

From 1930.

https://scholarship.law.berkeley.edu/cgi/viewcontent.cgi?article=3864&context=californialawreview

And it cites a Pennsylvania case from 1784 saying that opinions are not morally or legally required.
